AI check and social dialogue: is your CSE consulted in a timely manner?

Since 2025, judges have suspended, under penalty of fines, AI deployments undertaken without consulting the Works Council (CSE), including pilot projects. In 12 questions, this free check tells you if your AI projects involve employee representatives at the right time, with a red, orange, or green verdict, the gaps to address, and a 90-day action plan.

Get your verdict: red, orange, or green?

Twelve questions about the qualification of your projects, consultation with the Works Council, your agreements, and the monitoring of the tools. The results are displayed immediately, without registration. The detailed PDF report is then sent to you by email if you wish.

What the Labor Code requires for your AI projects

Since 2025, judges in summary proceedings have considered the introduction of AI tools as a new technology within the meaning of Article L. 2312-8 of the French Labor Code. In companies with at least 50 employees, the Works Council (CSE) must be consulted before any deployment, including pilot programs when the tool is actually used by employees (Nanterre Judicial Court, February 14, 2025), and authorizing a tool through a charter is equivalent to introducing it (Paris Court of Appeal, May 21, 2026). The consultation process requires a detailed written document and a one-month timeframe, two months in the case of an expert assessment, and three months if several establishments are consulted. The means of monitoring employee activity also fall under the consultation process (Article L. 2312-38). Failure to comply with this consultation process can result in the deployment being suspended under penalty of a fine.

Regarding the AI Act, the requirement to inform employee representatives before the implementation of a high-risk system, such as a recruitment or assessment tool (Article 26, paragraph 7), will apply from December 2, 2027, in addition to consultation with the Works Council. A robust procedure therefore rests on four pillars, which the check measures: qualifying, consulting, regulating, and monitoring.

Qualification

The regime for each project is qualified upstream (information, consultation, expertise), the pilot projects are supervised, and the uses already installed are regularized.

Consultation

The works council was consulted before deployment, a written and precise file was prepared, and a reverse schedule was established that incorporates legal deadlines and expertise.

Agreement and guarantees

A methodological agreement, structured activity monitoring functions, and individual written guarantees.

Tracking

The effects on jobs and skills presented with a training plan, shared indicators, and the anticipated high risk.

How is the verdict calculated?

Each answer is worth 0 to 3 points. The score for each pillar ranges from 8 to 100, and the overall score is the average, as in our other... AI diagnosticsThe verdict does not depend solely on the score: three key points carry more weight, because an audit will begin with them.

Red, high exposure. Score below 40, or one of the three key points missing: unqualified projects, CSE not consulted before deployment, activity monitoring functions neither identified nor submitted to the CSE.
Orange, a committed approach, a fragile procedure. The CSE is involved, but not always at the right time or with a sufficiently precise file.
Green, structured social dialogue. A score of at least 75, all three key points in place, and no answers at level zero.

And after the check?

Le AI kit and social dialogue of the sponsor Transforms your discrepancies into procedures: the decision tree in eight questions, the reverse schedule calculated from your deployment date, the information and consultation file template in twelve sections, the methodology agreement and the FAQ for elected officials, in Word and Excel. AI charter template gives you a charter to submit to the Works Council. Two other checks complete this one: the check article 4 of the AI Act on team formation and the Check GDPR compliance for AI usage.

The training plan is part of the documentation the Works Council expects. Our training courses are custom-designed for each group, using the tool actually deployed: details are on the page training organization.

F.A.Q

Does the check apply to my organization?

It targets companies with at least 50 employees and a works council (CSE), regardless of the AI tool deployed. In the public sector, the structures and regulations differ, but the underlying principle remains similar: involve employee representatives before deployment.

Does a Copilot pilot require consultation with the Works Council?

It depends on the pilot program. A pilot program that equips an entire department or is implemented over a long period is already considered a deployment (Nanterre Judicial Court, February 14, 2025). A truly voluntary test, limited in time and without any demonstrated impact on the organization, was not deemed a significant project (Paris Judicial Court, February 10, 2026). When in doubt, inform the Works Council beforehand and agree on a framework for the experiment.

Is a charter for the use of AI sufficient?

No. Authorizing and regulating by a charter a tool that employees were already using is to introduce it: the Paris Court of Appeal confirmed this on May 21, 2026. The charter and the list of authorized tools must therefore go through the CSE.

What does the PDF report contain?

The verdict and score, the results by pillar, all the identified gaps with the action to be taken for each, a 90-day action plan, and a reminder of the framework. You also receive the AI and Social Dialogue Toolkit, in Word and Excel formats. See a sample report (PDF, dummy answers).

Are my answers saved?

The verdict is displayed without registration, and your answers remain in your browser. If you request the report, your address and answers are used to send it to you and to discuss it with you; they are neither sold nor used for a newsletter.
