What Article 4 of the AI Act requires

Since February 2, 2025, Article 4 of the AI Act has required organizations that provide or use AI systems to take steps to develop the AI proficiency of their staff and others who use these systems on their behalf, taking into account their knowledge, experience, and the context of use. Omnibus Regulation (EU) 2026/1744, in force since July 27, 2026, has made this an obligation of means: it no longer requires guaranteeing a "sufficient level" for each individual. Enforcement has been the responsibility of national authorities since August 2, 2026.

In practice, a large organization must be able to demonstrate three things: that it knows who is using which tools, that it has taken measures tailored to each population group, and that it keeps track of these measures. This is precisely what the check measures, based on four pillars.

Perimeter

An inventory of AI tools, including spontaneous uses, and a mapping of populations by role and exposure.

Governance

A designated pilot, a disseminated usage charter, and AI mastery included in the skills development plan.

Training

A basic training course for all users, career paths tailored to each role, risks for those involved and covered service providers.

Evidence and follow-up

A record of who has been trained, on what and when, a measure of effectiveness and an update with each new tool.

How is the verdict calculated?

Each answer is worth 0 to 3 points. The score for each pillar ranges from 8 to 100, and the overall score is the average, as in our other... AI diagnosticsThe verdict does not depend solely on the score: three key points carry more weight, because an audit will begin with them.

Red, high exposure. Score below 40, or one of the three key points missing: no inventory of tools, no basic training, no record of training.
Orange, committed approach, incomplete evidence. Measures exist, but they do not cover all populations or are not sufficiently documented.
Green, a solid and demonstrable approach. A score of at least 75, all three key points in place, and no answers at level zero.

And after the check?

Le AI training plan template It transforms your gaps into a plan: six populations, four levels, a timeline, a budget, and an AI mastery log, in Word and Excel. Sponsor's AI Act Kit details what applies to your organization and the method for building the program, and the AI charter template covers the rules of use. Two other checks complete this one: the Check GDPR compliance for AI usage and the AI check and social dialogue regarding the consultation of the Works Council. To provide a broader context for your organization, the Adoption diagnostics, Agents and Cowork are also freely accessible.

Our training courses comply with Article 4: they are custom-designed for each target group, using the tool actually deployed, and attendance sheets and certificates serve as a record of the actions taken. Details are available on the page training organization.

F.A.Q

Does Article 4 apply to my organization?

Yes, as soon as your employees use AI systems in a professional setting—an assistant like Microsoft 365 Copilot, ChatGPT, Claude, or Gemini—your organization is considered a deployer under the AI Act. This obligation applies regardless of the perceived risk level of the usage.

What has changed with the omnibus regulation of July 2026?

Regulation (EU) 2026/1744, in force since 27 July 2026, has made Article 4 an obligation of means: appropriate measures must be taken to develop AI proficiency, without having to guarantee a sufficient level for every individual. The Commission and Member States must support these efforts, particularly those of SMEs.

Does the check replace a legal audit?

No. It relies solely on your answers and provides a quick overview of your exposure and priority actions. It's a decision-making tool, not legal advice.

What does the PDF report contain?

The verdict and score, the results by pillar, all identified gaps with the action plan for each, a 90-day action plan, and a reminder of the framework. You also receive the AI training plan template in Word and Excel formats.
